Course Description:

This seminar will survey the major sources of law with respect to privacy concerns relevant to the insurance industry.  The seminar begins with a description of some of the current issues in privacy and a view of the statistics showing consumer concern about (and dissatisfaction with the current state of) privacy issues.  
 
            The single largest segment of the seminar focuses on federal law, particularly HIPAA as it pertains to medical records.  Insurance industry personnel, whether working primarily in life and health or property and casualty, frequently encounter medical information (especially in the claims arena) that may be subject to privacy requirements.  Additionally, this segment will explain the genesis of the anti-sharing and opt-out rules and privacy protections of the Gramm Leach Bliley Act and the regulations implementing GLBA, along with a few remarks about the Fair Credit Reporting Act.  
 
            From there, the seminar turns to a discussion of state law.  A brief description of the privacy statutes and regulations that can impact employment records introduces this section, as it demonstrates the interplay between federal and state laws.  The seminar then turns to the common law development of the tort of invasion of privacy and related matters.
 
The seminar’s other major section reviews the risk management aspects of a privacy policy, not only for agencies themselves, but also for their clients.  The major discussion here is how to develop an effective and practical privacy policy.  Another section of the seminar discusses the advent of insurance-related policies to cover security breaches and the like, discussing how these policies differ from standard CGL or BOP type policies.

John rejoined Arlington/Roe in 2012 as vice president, professional liability and brokerage. His focus is in placing coverage for professional liability, management liability and casualty risks. John has been placing Cyber Liability insurance for risks since 2004 when only a few carriers offered this product.  John previously worked for a large independent insurance agency in Illinois, returning to Arlington/Roe with retail agency experience. In a prior capacity at Arlington/Roe he was a professional liability producer and the Illinois State Manager responsible for the growth of all of the company’s products and services in Illinois. He had also worked as a business consultant in project development, internal controls, management and marketing.

John is a member of the Professional Liability Underwriter’s Society (PLUS) and sits on the Midwest Steering Committee. He sits on the IIA of Illinois Educational Committee, the Agent’s Insurance Services Board and he is a licensed P&C agent. He received his Certified Insurance Counselor (CIC) designation in 2006, his Registered Professional Liability Underwriter (RPLU) designation in 2008 and the Certified Risk Manager (CRM) designation in 2010.

John has spoken at various functions on the topics of Employment Practices, Directors and Officers Liability, Privacy and Network Security.
